Expanding operations into Texas and the New York/Northeast region, Irby Utility Supply LLC, Jackson, Miss., has acquired the assets of what was previously Cummins Utility Supply.

The United States Bankruptcy Court of the Northern District of Texas approved the sale of Cummins Utility Supply on Nov. 28 to Irby Utility Supply. In what appeared to be a surprise move, according to Michael Anthony, chief operations officer for Stuart C. Irby Co., Cummins Utility Supply filed for protection under Chapter 11 of the U.S. Bankruptcy Code in October.

The acquisition will give Irby Utility a geographic presence in New York and Texas. Irby will continue to operate the Cummins' locations in Huntsville, Ala.; Forth Worth; Austin; Tyler, Texas; and Syracuse, N.Y., said Anthony. The company also acquired inventory and fixed assets from Cummins in Phoenix; Indio, Calif.; Kansas City; Mobile, Ala.; Alexandria, La.; and Las Vegas.

Stuart C. Irby Co., the parent of Irby Utility Supply, is among 15 largest electrical distributors in the United States, according to Electrical Wholesaling's list of the 250 largest electrical distributors, and had $321 million of sales in its fiscal year ending Sept. 31, 2001.
